An internship, a Werkstudent job, a university assistant role, a company thesis, and a dual study programme can all provide practical experience. They are not interchangeable legal categories.
Before accepting a role, check five separate questions:
A job title alone does not answer those questions.
Last reviewed: June 7, 2026. This guide focuses on third-country degree students, including Indian students, who study in Germany under Section 16b of the Residence Act. Check your residence document, university rules, employer payroll classification, and health insurer before starting work.
| Role | Main purpose | Key evidence | Main risk |
|---|---|---|---|
| Mandatory internship | Required part of the degree | Study/examination rules and university confirmation | Employer calls a voluntary role "mandatory" |
| Voluntary internship | Additional practical experience | Internship contract and enrolment | Work-day and minimum-wage rules misunderstood |
| Werkstudent job | Ongoing employment alongside study | Employment contract and enrolment | Confusing social-insurance status with immigration permission |
| Student auxiliary role | Academic or university-related work | University/research contract and duties | Assuming every job with "student" in the title is exempt |
| Company thesis | Academic thesis, sometimes with company access | Thesis agreement and university supervision | Unpaid thesis arrangement includes ordinary productive work |
| Dual study | Integrated study and company phases | Admission plus training/practice contract | Assuming every model has the same degree, pay, fees, or residence title |

Section 16b(3) permits employment up to 140 workdays per year without Federal Employment Agency approval. The statute provides a workday account, not merely a simple 140-versus-280 slogan.
Part-time work is counted in the student's favour, week by week:
The more favourable calculation is selected for each calendar week.
Official sources:
Section 16b states that student auxiliary activities are not charged to the workday account. Do not assume that every company job titled "student assistant" or "Werkstudent" qualifies.
Academic work at a university, research institute, or closely related academic setting may be treated differently from ordinary commercial employment. Ask the employer and foreigners authority how the actual duties are classified if the distinction affects your remaining work account.
The standard student-employment permission does not automatically authorise freelance or self-employed activity. Make it in Germany states that self-employment requires approval from the competent foreigners authority, which considers whether it may hinder the studies.
Do not accept a freelance contract as a workaround for employee limits without written authority guidance.

Multiple employers do not create separate allowances.
A Pflichtpraktikum is mandatory because an applicable school, training, university, or examination rule requires it. A professor's recommendation or an employer's label is not enough.
Section 16b(1) includes completion of a mandatory internship within the purpose of study. Before signing, obtain:
Section 22 of the Minimum Wage Act excludes genuine compulsory internships required by the relevant education rules from statutory minimum-wage coverage.
That means the employer may legally offer less than the minimum wage or no remuneration under that statute. It does not mean every unpaid mandatory internship is financially workable or contractually fair.
Confirm:
Social-insurance treatment depends on the exact internship type, timing, enrolment status, and remuneration. German Pension Insurance guidance distinguishes prescribed interim internships from non-prescribed internships.
Do not infer payroll treatment from the minimum-wage result. They are separate legal systems. Ask the employer's payroll team and your health insurer for the classification in writing.
A voluntary internship is additional experience rather than a curriculum requirement. It normally uses the residence-law work account unless another specific rule applies.
Interns are generally covered by the statutory minimum wage. Section 22 creates limited exceptions, including:
If a qualifying voluntary internship lasts longer than three months, BMAS states that the minimum wage applies to the entire internship from the first day, not only from month four.
Germany's statutory minimum wage is EUR 13.90 gross per hour from January 1, 2026.
Use:
The statement "voluntary internships under three months are unpaid" is wrong. The exception depends on purpose, duration, training context, and prior relationship with the same provider. Employers can also choose to pay where no statutory obligation exists.
Before accepting a full-time placement:
"Werkstudent" is commonly used for an enrolled student's ongoing part-time employment. It does not create an extra immigration allowance.
The role is subject to:
The Werkstudent privilege is a social-insurance rule. German Pension Insurance states that students in more-than-marginal employment are generally exempt from health, long-term-care, and unemployment insurance through that employment when study remains predominant. This is normally assumed at no more than 20 working hours per week.
Pension insurance generally remains relevant. The student also needs separate valid health-insurance coverage; "exempt through employment" does not mean uninsured.
Limited work above 20 hours can sometimes preserve the privilege when the additional work occurs at weekends, during evenings or nights, or solely in semester breaks and the applicable 26-week conditions are satisfied.
Multiple jobs and recurring excess hours matter. Let the employer and health insurer assess the complete pattern.
See German Pension Insurance: Werkstudent privilege.
Do not merge:
The same number appears in both systems, but the purpose, calculation, and consequences differ.
Where the Minimum Wage Act applies, a Werkstudent employee must receive at least EUR 13.90 gross per hour in 2026. Market pay varies by duties, experience, collective agreement, location, and employer.
There is no reliable universal EUR 15-EUR 24 range and no guarantee that a student role leads to a graduate offer.

Do not describe a commercial startup role as a HiWi merely because it is technical or part-time.
A company thesis can range from an academic project with workspace access to an employment relationship that also includes a thesis.
BMAS states that merely writing a study-related final thesis for a company is not an internship when the student performs no work for the company. If the arrangement includes productive company work, an internship or employment relationship may exist and wage rules can apply.
Clarify:
Never sign a confidentiality clause that prevents the university from examining the thesis without obtaining an approved solution.
The Federal Employment Agency distinguishes:
Only the training-integrated model necessarily produces both the degree and a recognised vocational qualification.
Before accepting:
German at C1 is not a universal statutory requirement. The institution and employer set language requirements.
Tuition is not universally covered, and employment after graduation is not guaranteed.
There is no universal answer that every dual-study participant uses an ordinary student visa. The correct purpose can depend on whether full-time study or vocational training is the principal structure and on the specific contracts.
Obtain confirmation from the German mission or foreigners authority before travel or before changing from a standard degree.
See:
Werkstudent pay and paid internships are not automatically tax-free.
For employment, the employer generally uses the tax identification number and electronic wage-tax information to calculate payroll withholding. Wage tax withheld during the year is a prepayment toward annual income tax, not necessarily the final liability.
Your result depends on factors including:

Pause before accepting when:
A genuine internship required by the applicable study or examination rules forms part of the Section 16b study purpose. Keep university proof and check the exact residence wording, especially if the placement differs from the approved curriculum or you hold another job at the same time.
No. The Section 22 exception depends on the internship's purpose, relationship to training or study, duration, and prior relationship with the same provider.
No. It is an employment label and, importantly, a social-insurance classification. A third-country student still needs residence permission for the work.
The immigration work-account and social-insurance rules both contain provisions relevant to lecture-free periods, but they calculate consequences differently. Confirm the schedule with the employer and insurer and keep the Section 16b account.
Often the Werkstudent privilege removes health, care, and unemployment contributions through the employment while pension insurance remains. The outcome depends on the complete work pattern and student status. Obtain payroll and insurer confirmation.
BMAS says a pure thesis arrangement with no productive work for the company is not an internship. If ordinary work is also performed, employment or internship wage rules may apply.
The up-to-18-month permit for graduates of German institutions permits any type of job while searching for qualified employment, subject to obtaining that residence title and meeting its conditions. An internship does not by itself secure the later skilled-employment title.
See Make it in Germany: prospects after graduation.
Only a training-integrated model normally combines a degree with a recognised vocational qualification. Practice-integrated programmes provide structured company experience but not necessarily a second formal qualification.
Choose the role only after its real legal and academic classification is clear. Record the workday account, prove a mandatory internship through university rules, test minimum-wage exceptions precisely, separate Werkstudent social insurance from immigration permission, and review the contract as carefully as the job description.
Practical experience is valuable. Misclassification can affect pay, insurance, degree progress, and residence compliance.
